End-User License Agreement

1. License Grant

Billed Out grants you a non-exclusive, non-transferable license to use the Software in accordance with the terms of this Agreement. You may install and use the Software on a single device unless otherwise specified. This license is personal and cannot be shared, transferred, or sublicensed.

2. Restrictions

You may not:

  • Modify, reverse engineer, disassemble, decompile, or create derivative works of the Software.
  • Rent, lease, sublicense, distribute, or transfer the Software to any third party.
  • Use the Software in any unlawful manner or in violation of any applicable laws or regulations.

3. Ownership

The Software is licensed, not sold. All rights, title, and interest in and to the Software, including all intellectual property rights, remain with Billed Out and its licensors. The Software is protected by copyright law and international treaties.

4. Updates

Billed Out may, from time to time, provide updates or patches to the Software. These updates may be governed by the terms of this Agreement or by a separate agreement that will accompany the update.

5. Warranty Disclaimer

The Software is provided "as is," with no warranties, express or implied. Billed Out does not guarantee that the Software will be error-free or uninterrupted. You assume all risks associated with the use of the Software.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Billed Out shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Software, even if Billed Out has been advised of the possibility of such damages.

7. Termination

This Agreement is effective until terminated. You may terminate it at any time by unsubscribing. Billed Out may terminate this Agreement if you violate any terms of this Agreement. 

8. Privacy and Data Collection

By using the Software, you acknowledge and agree that Billed Out may collect certain data related to the Software's performance, usage, and other technical information. Billed Out may use this data in accordance with its Privacy Policy.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Washington State, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be resolved in the courts located in Washington State.

10. Miscellaneous

  • If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • This Agreement constitutes the entire agreement between the parties regarding the Software and supersedes all prior agreements or communications, whether written or oral.
